Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you (“you” or “Customer”) and TourBookingPlatform (“we”, “us”, or the “Service”). By creating an account, clicking “I agree”, or using the Service, you accept these Terms. If you do not agree, do not use the Service.
1. The Service
TourBookingPlatform is a software-as-a-service platform that helps tour operators and travel businesses manage tours, bookings, calendars, payments, guests, and related operations. The Service is provided on a subscription basis and is accessed via the web.
2. Your account
You must provide accurate information when creating your account and keep it current. You are responsible for all activity that occurs under your account and for safeguarding your password. Tell us immediately if you suspect unauthorized access. You must be at least 18 years old and have legal authority to enter into these Terms on behalf of your business.
3. Trial, subscriptions, and billing
New accounts may receive a free trial of a limited duration. After the trial, continued use requires a paid subscription. Fees are charged in advance for the billing period you select and are non-refundable except where required by law. We may change pricing on renewal; we will give you reasonable advance notice. Overdue accounts may be suspended or terminated.
4. Your content and data
You retain ownership of the content, tours, guest information, and other data you submit to the Service (“Customer Data”). You grant us a limited licence to host, process, and transmit your Customer Data solely to provide the Service to you. You are responsible for the lawfulness of the Customer Data you upload, including obtaining any consents required from your guests.
5. Acceptable use
You must not:
- use the Service to violate any law or third-party rights;
- upload malware, attempt to gain unauthorized access, or probe for vulnerabilities outside a sanctioned programme;
- reverse engineer, resell, or white-label the Service without our written consent;
- send spam, unsolicited bulk messages, or deceptive content through the Service;
- interfere with the Service or other customers’ use of it.
6. Payments to you
Payments from your guests may be processed through third-party providers (such as Stripe). Those providers have their own terms and you are responsible for accepting them. We do not guarantee the availability of any particular payment provider.
7. Third-party services
The Service may integrate with third-party products. Your use of those products is governed by their own terms. We are not responsible for third-party products and make no representations about them.
8. Intellectual property
The Service, including its software, design, and trademarks, is owned by us or our licensors. Except for the limited rights granted in these Terms, no rights are transferred to you.
9. Confidentiality
Each party will protect the other’s non-public information with reasonable care and use it only to perform under these Terms.
10. Warranty disclaimer
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
11. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data. Our total aggregate liability under these Terms will not exceed the fees you paid us in the twelve months preceding the event giving rise to liability. Nothing in these Terms limits liability that cannot lawfully be limited.
12. Indemnity
You will defend and indemnify us against claims arising from your Customer Data, your breach of these Terms, or your violation of law or third-party rights.
13. Term and termination
These Terms apply while your account is active. You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period. We may suspend or terminate your account for material breach, unpaid fees, or legal risk. On termination, your right to use the Service ends and we may delete Customer Data after a reasonable grace period.
14. Changes to the Terms
We may update these Terms from time to time. If a change is material, we will give reasonable notice (for example, by email or in-product notice). Continued use of the Service after the change takes effect means you accept the revised Terms.
15. Governing law
These Terms are governed by the laws applicable at the place of our registered seat, without regard to conflict of laws rules. Any dispute will be resolved in the competent courts at that seat, unless mandatory consumer-protection law provides otherwise.
